How service of process works in California

California recognizes eight key rules governing service of legal documents. Defective service is one of the most common ways cases get delayed. Every rule below is built into ABC Legal's platform, so your serve is compliant by default. Expand any method to see the rule, and exactly what it means for your case.
Personal service—the gold standard CCP § 415.10
Papers are handed directly to the person named—California's most direct method. Under CCP § 415.10, service is complete at the moment of delivery.
"by personal delivery of a copy of the summons and of the complaint to the person to be served" (service deemed complete at time of delivery). — CCP § 415.10

With ABC Legal: a vetted local process server makes the first attempt based on your speed tier timeline—as fast as 48 hours—and EvidenceChain™ records the GPS location and timestamp of the exact delivery moment.

Substituted service CCP § 415.20
If the person cannot be reached with reasonable diligence, a copy may be left at their dwelling, usual place of abode, place of business, or usual mailing address with a competent member of the household or a person apparently in charge (at least 18), then a copy is mailed. Service is complete on the 10th day after mailing.
CCP § 415.20(b): service by "leaving a copy of the summons and complaint at the person’s dwelling house, usual place of abode, usual place of business, or usual mailing address … in the presence of a competent member of the household or a person apparently in charge … at least 18 years of age … deemed complete on the 10th day after the mailing." (Operative version: Stats. 2025, Ch. 563, Sec. 4 (AB 747), eff. 1/1/2026–1/1/2027.) — CCP § 415.20

With ABC Legal: courts only accept substituted service after documented diligence. Our app geotags and timestamps every attempt automatically, so your diligence record is built before you need it.

Gated communities can't block service CCP § 415.21
Guarded gates must admit registered process servers to attempt service—one reason registration matters in gated-heavy metros like Orange County and Palm Springs.
"any person shall be granted access to a gated community... for a reasonable period of time for the sole purpose of performing lawful service of process." — CCP § 415.21

With ABC Legal: every one of our California servers is county-registered, so gate guards are required by law to let them through—no wasted attempts at the gate.

Service by mail CCP § 415.30
Valid only when the recipient signs and returns an acknowledgment of receipt—without the signed acknowledgment, service by mail doesn't count.
Summons served by first-class mail with a notice and acknowledgment of receipt; "service... is deemed complete on the date a written acknowledgement of receipt of summons is executed." — CCP § 415.30

With ABC Legal: we recommend personal service first—it starts deadlines immediately and never depends on the recipient cooperating.

Service by publication CCP § 415.50
Court-approved notice in a newspaper when the defendant cannot, with reasonable diligence, be served another way (CCP § 415.50)—a last resort supported by documented diligent attempts.
Court may order publication where the party "cannot with reasonable diligence be served in another manner specified in this article." — CCP § 415.50

With ABC Legal: our skip tracing team locates most “unfindable” defendants before you ever pay for publication—and if it truly comes to that, your ABC attempt history is the diligence evidence the motion needs.

Serving a corporation CCP § 416.10
Deliver to the company's registered agent for service of process, or to a corporate officer.
Serve "the president, chief executive officer, or other head... a vice president, a secretary... a general manager, or a person authorized by the corporation to receive service of process." — CCP § 416.10

With ABC Legal: our servers are well-versed in serving legal documents to businesses, and our partnership with CT Corporation means timely service to the companies they are the registered agent for.

Serving an LLC or association CCP § 416.40; Corp. Code § 17701.16
Deliver to the entity's designated agent, or to an officer or managing agent.
§ 416.40: "A summons may be served on an unincorporated association (including a partnership) by delivering a copy of the summons and of the complaint"; § 17701.16: personal service by delivery to any individual the LLC designates as agent constitutes valid service. — CCP § 416.40; Corp. Code § 17701.16

With ABC Legal: our servers are well-versed in serving legal documents to businesses, and our partnership with CT Corporation means timely service to the companies they are the registered agent for.

Serving a government entity CCP § 416.50
Deliver to the clerk, secretary, president, or presiding officer of the public entity.
Serve a public entity "by delivering a copy of the summons and of the complaint to the clerk, secretary, president, presiding officer, or other head of its governing body." — CCP § 416.50

With ABC Legal: our servers handle city, county, and state entity serves routinely, combining field experience with compliance to local rules for smooth delivery.

Commonly asked questions

California FAQs

How much does a process server cost in California?
Service-of-process costs vary by provider, so it's worth confirming whether pricing is all-inclusive or adds fees for mileage, out-of-area locations, multiple attempts, or proof of service. With ABC Legal, pricing is flat per party and address—no mileage fees, no per-attempt charges, and court-ready proof of service is always included. Standard, priority (first attempt within 3 days), and rush (first attempt within 48 hours) options are available; California's current starting rate is shown in the pricing section on this page.
Who can serve legal papers in California?
In California, any person 18 or older who isn't a party to the case may serve papers (CCP § 414.10). Anyone serving more than 10 papers a year must register as a process server with their county clerk and post a bond (Business & Professions Code § 22350). All of ABC Legal's California servers are registered, vetted, and continuously monitored.
How long does service of process take in California?
Completing service of process properly can take time. Local laws dictate how, when, and to whom service may be completed, and sometimes delivery agents must make multiple attempts to legally complete it. With ABC Legal, most serves complete within 3–7 days: a first attempt within 48 hours on rush orders, within 3 days on priority orders, and generally within the first week on standard orders. Note the filing deadline—60 days from filing to serve and file proof (Cal. Rules of Court 3.110(b)).
What are the California rules for service of process, and do you follow them?
California service is governed by the Code of Civil Procedure: personal service (§ 415.10), substituted service after reasonable diligence (§ 415.20), mail with acknowledgment (§ 415.30), and court-approved publication (§ 415.50). Compliance is the product—every ABC Legal serve follows these statutes and produces a proof of service your court accepts. ABC Legal provides oversight of process servers that isn't available from any other provider: we vet their credentials, monitor their activity, provide support if service is contested, and require data-backed evidence in addition to standard documentation to ensure compliance with California law.
What if the person is avoiding service?
Since personal service is preferred, evasion can be an issue—but it doesn't have to stop a case. After documented diligent attempts, California allows alternatives such as substituted service under CCP § 415.20, and other court-allowed forms of alternative service if substituted service isn't possible. At ABC Legal, our process servers record every attempt with GPS coordinates, timestamps, photos, and notes—exactly the evidence a court needs to confirm diligence and support a motion for alternative service. For legal professionals, if service can't be completed at the first address we provide the next best address to reach the individual, and programs such as Avoider Protection™ help ensure documents get served even in tricky situations.
Can you serve papers anywhere in California, including gated communities?
Yes—service is generally allowed in most locations, and in California gated communities must grant access to registered process servers under CCP § 415.21. Because ABC Legal maintains a robust network of local registered process servers in California, we can cover delivery in every city and ZIP code, even when the community is gated.
What documents can you deliver in California?
All forms of legal documents may be delivered by a process server, unless delivery by a different agent is required or allowed by law. At ABC Legal, we can deliver any document, including but not limited to summonses and complaints, subpoenas, divorce and family-law papers, eviction documents, small claims papers, restraining orders, writs, levies, garnishments, judgments, and post-judgment documents.
