How service of process works in Pennsylvania

Pennsylvania sets specific rules for how legal documents must be delivered, and defective service is one of the most common ways cases get delayed. Every rule below is built into ABC Legal's platform, so your serve is compliant by default. Expand any method to see the rule, and exactly what it means for your case.
Personal service—the gold standard Pa. R.C.P. 402(a)(1)
In Pennsylvania, personal service is made by handing a copy of the writ or complaint directly to the defendant under Rule 402(a)(1)—the most direct method, with no witnesses or family members required. Statewide, the sheriff generally performs original service; a competent adult may serve only in narrow categories such as injunctive-relief, partition, declaratory-judgment-only, and complete-diversity actions.
Pa.R.C.P. 402(a): "Original process may be served (1) by handing a copy to the defendant..." — Pa. R.C.P. 402(a)(1)

With ABC Legal: a vetted server makes the first attempt on your tier's timeline—as fast as 48 hours—and EvidenceChain™ records the GPS location and timestamp of the exact delivery moment.

Substituted service Pa. R.C.P. 402(a)(2)
When the defendant can't be handed the papers personally, Rule 402(a)(2) allows a copy to be left at the residence with an adult family member the defendant lives with—or, if none is present, an adult in charge of the residence. It may also go to the clerk or manager where the defendant lodges, or the person in charge at the defendant's office or business.
Pa.R.C.P. 402(a)(2): "by handing a copy (i) at the residence of the defendant to an adult member of the family with whom he resides; but if no adult member of the family is found, then to an adult person in charge of such residence; or (ii) at the residence of the defendant to the clerk or manager of the hotel, inn, apartment house, boarding house or other place of lodging at which he resides; or (iii) at any office or usual place of business of the defendant to his agent or to the person for the time being in charge thereof." — Pa. R.C.P. 402(a)(2)

With ABC Legal: courts only accept substituted service after documented diligence. Our app geotags and timestamps every attempt automatically, so your diligence record is built before you need it.

Service by mail Pa. R.C.P. 403
Pennsylvania has no freestanding mail option for in-state defendants—Rule 403 applies only when another rule authorizes mail, such as service outside the Commonwealth. Where it applies, the process must go by a form of mail requiring a receipt signed by the defendant or an authorized agent, complete upon delivery. Refused mail may be re-sent by ordinary mail; unclaimed mail requires another method.
Pa.R.C.P. 403: "If a rule of civil procedure authorizes original process to be served by mail, a copy of the process shall be mailed to the defendant by any form of mail requiring a receipt signed by the defendant or his authorized agent. Service is complete upon delivery of the mail." — Pa. R.C.P. 403

With ABC Legal: we recommend personal service first—it starts deadlines immediately and never depends on the recipient cooperating.

Service by publication Pa. R.C.P. 430
Service by publication isn't available on demand—under Rule 430 the plaintiff must first move for a special order and file an affidavit detailing the investigation made to locate the defendant and why other service failed. If the court authorizes it, notice is advertised once in the county's designated legal publication and a newspaper of general circulation, using the prescribed warning form.
Pa.R.C.P. 430(a): "If service cannot be made under the applicable rule the plaintiff may move the court for a special order directing the method of service." — Pa. R.C.P. 430

With ABC Legal: our skip tracing team locates most "unfindable" defendants before you ever pay for publication—and if it truly comes to that, your ABC attempt history is the diligence evidence the motion needs.

Serving a corporation or LLC Pa. R.C.P. 424
To serve a Pennsylvania corporation or similar entity, Rule 424 requires handing a copy to an executive officer, partner or trustee; the manager, clerk or person in charge of any regular place of business or activity; or an agent authorized in writing to accept service. The person served can't be a plaintiff, and the residence-based substituted service of Rule 402(a)(2) is not permitted here.
Pa.R.C.P. 424: "Service of original process upon a corporation or similar entity shall be made by handing a copy to any of the following persons provided the person served is not a plaintiff in the action: (1) an executive officer, partner or trustee of the corporation or similar entity, or (2) the manager, clerk or other person for the time being in charge of any regular place of business or activity of the corporation or similar entity, or (3) an agent authorized by the corporation or similar entity in writing to receive service of process for it." — Pa. R.C.P. 424

With ABC Legal: we verify the current registered agent against state records before dispatch, so the serve lands on the right desk the first time.

Serving a government entity Pa. R.C.P. 422
Rule 422 splits government service. For the Commonwealth or its officers, departments, boards or commissions, a copy goes to the person in charge at both the defendant's office and the Office of Attorney General. For a political subdivision, serve an authorized agent, the person in charge at its office, or an official such as the mayor or the tax-levying body's president or secretary.
Pa.R.C.P. 422(a): "Service of original process upon the Commonwealth or an officer of the Commonwealth, or a department, board, commission or instrumentality of the Commonwealth, or a member thereof, shall be made at the office of the defendant and the office of the attorney general by handing a copy to the person in charge thereof." — Pa. R.C.P. 422

Commonly asked questions

Pennsylvania FAQs

How much does a process server cost in Pennsylvania?
ABC Legal uses flat-rate pricing with three tiers—standard, priority (first attempt within 3 days), and rush (first attempt within 48 hours). Pricing is flat per party and address: no mileage fees, no per-attempt charges, and the court-ready proof of service is included. Current Pennsylvania rates are shown in the pricing section above.
Who can serve legal papers in Pennsylvania?
Service must be made by a competent adult who is not a party to the case. Pennsylvania sets the specific requirements under Pa. R.C.P. 400–441. All of ABC Legal's Pennsylvania servers are vetted, trained, and continuously monitored.
How long does service of process take in Pennsylvania?
Most serves complete within 3–7 days. First attempts happen within 48 hours on rush orders, 3 days on priority, and within the first week on standard. Note the filing deadline: original process must be served within 30 days of issuance (Pa. R.C.P. 401).
What are the Pennsylvania rules for service of process, and do you follow them?
Pennsylvania service is governed by Pa. R.C.P. 400–441, covering personal service (Pa. R.C.P. 402(a)(1)); substituted service (Pa. R.C.P. 402(a)(2)); service by mail (Pa. R.C.P. 403); service by publication (Pa. R.C.P. 430). Compliance is the product—every ABC Legal serve follows these rules and produces a proof of service your court accepts.
What if the person is avoiding service?
Evasion doesn't stop a case. After documented diligent attempts, Pennsylvania allows alternatives such as substituted service under Pa. R.C.P. 402(a)(2). We record every attempt with GPS, timestamps, and notes—exactly the evidence a court needs. If the person's address is unknown, our skip tracing team locates them first.

Yes. We maintain vetted servers across all 67 counties, covering every city and ZIP code.
What documents can you deliver in Pennsylvania?
Summonses and complaints, subpoenas, divorce and family law papers, eviction documents, small claims papers, restraining orders, writs, levies, garnishments, judgments, and post-judgment documents.
