Are you a law firm or business that regularly requires service of process? People don't like being sued, and sooner or later you'll face defendants claiming they weren't properly served.

Defendants may claim they weren't home, say they don't live at the address, or say the process server delivered the documents to someone else entirely. All these assertions can lead to frustration, delays in legal proceedings, and even possible dismissal on the case you've worked so hard to prepare.

What happens next depends on who you've got in your corner.

Keep reading to learn how ABC Legal ensures the reliability and accuracy you need to navigate these challenges easily and successfully.

Thorough Compliance Investigations

At ABC Legal, any concerns about the validity of service trigger an immediate and thorough compliance investigation.

Our process servers report service, capture photos, and record GPS coordinates and timestamps through a mobile application. This technology allows us to conclusively demonstrate that the process server was at the correct location at the time of service.

To ensure accuracy, the GPS coordinates recorded by the process server’s phone are cross-referenced with the expected coordinates for the address.

Detailed Reporting and Verification

Our mobile app requires process servers to log over 30 different characteristics of the serve. This includes physical descriptions of the person served, observations about the property such as overgrown grass or utility meter status, and any notable features, such as vehicles in the driveway. Our compliance team meticulously records and reviews all this data, conducting thorough interviews with the process server and preparing a detailed affidavit.

The affidavit provides a comprehensive context for why the specific address was chosen for service. While our customers typically provide the address, ABC Legal also conducts database checks across 11 different data resources. This verification process includes cross-referencing driver's licenses, credit records, vehicle registrations, and property ownership to ensure the accuracy of the address.

Maintaining High Standards and Compliance

To guarantee the integrity of our process servers, our case management system actively manages their credentials in real-time. This system verifies that each process server holds the proper licenses, driver’s licenses, and insurance and has agreed to all required policies.

If a process server fails to meet these criteria, they are not assigned work. This rigorous vetting process ensures that we can confidently confirm in court that the process server was indeed qualified to serve the documents.

ABC Legal runs continuous plausibility and compliance checks. For instance, our system analyzes the timing between service attempts to ensure they are realistic, flagging any discrepancies for further review. We maintain a zero-tolerance policy on dishonesty and compliance violations, upholding the highest standards for our process servers.

Supporting Legal Proceedings

If a question arises about the validity of service, we have your back with extensive support. This includes providing detailed information and affidavits and, if necessary, making arrangements for the process server to appear at a hearing.

In situations where the person served was not the intended recipient (for example, due to a similar name or language barrier), ABC Legal thoroughly reviews the case and re-serves the documents at no additional cost, ensuring our clients are fully covered.

Technology and Policies to Prevent Fraud

Our process servers are required to take photos on-site through the ABC Legal app. This requirement ensures the authenticity of the service documentation. Additionally, we pay our process servers per address attempted, rather than per successful service. This policy prevents incentivizing false reports of service and promotes accurate and honest performance.
